Governing Law and Jurisdiction
THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF HAWAII, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF HAWAII.
Miscellaneous
This Agreement constitutes the entire agreement between 808 Deals and you with respect to your use of the 808 Deals Web Site. Any cause of action you may have with respect to your use of the 808 Deals Web Site must be commenced within one (1) year after the claim or cause of action arises. If, for any reason, a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect. 808 Deals disclaims any and all responsibility for content contained in any third party materials provided through LINKs from the 808 Deals Web Site. 808 Deals's failure to insist upon strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.

You are solely responsible for any content, whether written or recorded, that is posted, uploaded, published or placed on the 808 Deals Web Site, and that is transmitted through any and all media, which shall include but not be limited to, Forums, chat rooms, video recordings, sound recordings, bulletin boards, web logs (aka blogs), or message boards (collectively "Your Content"). As a result, 808 Deals does not and will not endorse Your Content or any opinion, recommendation, or advice expressed therein, and 808 Deals expressly disclaims and will not be responsible for any and all liability in connection with Your Content. You agree not publish falsehoods or misrepresentations. You agree not to submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate. We do not accept unsolicited materials or ideas for use or publication in the 808 Deals Web Site, or other digital and electronic media (except in connection with Forums on the 808 Deals Web Site). 808 Deals shall not be responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to the 808 Deals Web Site. You acknowledge that transmission to and from this 808 Deals Web Site are not confidential and your communications may be read or intercepted by others. You acknowledge that by submitting communications to 808 Deals, no confidential, fiduciary, contractually implied or other relationship is created between you and 808 Deals other than pursuant to this Agreement.
Governing Law and Jurisdiction
THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF HAWAII, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF HAWAII.
Miscellaneous
This Agreement constitutes the entire agreement between 808 Deals and you with respect to your use of the 808 Deals Web Site. Any cause of action you may have with respect to your use of the 808 Deals Web Site must be commenced within one (1) year after the claim or cause of action arises. If, for any reason, a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect. 808 Deals disclaims any and all responsibility for content contained in any third party materials provided through LINKs from the 808 Deals Web Site. 808 Deals's failure to insist upon strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide 808 Deals's Copyright Agent the following information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. 512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
